Residency Requirements
To be eligible to divorce in the state of New York, one of the following conditions must be met:
- Either party has resided in the state of New York continuously for at least two years before filing.
- Either party has been living in the state of New York for at least one year before the divorce, given the fact that the marriage occurred in New York.
- Either party has been living in the state of New York for at least one year, and the parties have resided in the state of New York as a married couple.
- Both spouses are current residents of the state of New York when filing for divorce, and the ground for the divorce occurred in the state.
